Privacy
DAM LLC (“we”, “us” or “our”) operates davidmiskin.com and is responsible for the personal information described in this Privacy Policy. This policy explains how we handle information when you visit the website, use its contact form or communicate with us about an enquiry.
1. Information we collect
When you use the contact form, we collect your first and last name, company, email address and message. If you contact us another way, we receive the information you choose to share, including your contact details and correspondence. Please do not send sensitive personal information or confidential project materials through a general enquiry.
Our hosting and content-delivery providers process technical information needed to deliver and protect the website, such as IP addresses, browser and device information, requested pages and access times.
2. How we use information
We use enquiry information to respond to messages, discuss potential projects, manage business communications and keep records of our exchanges. We use technical information to operate, maintain, understand and protect the website, prevent spam and misuse, and meet applicable legal obligations.
Where applicable law requires a legal basis, the basis depends on the purpose. It may include our legitimate interests in responding to enquiries and operating the website, taking steps at your request before entering into an agreement, compliance with legal obligations, or consent where required. Where processing relies on consent, you may withdraw it without affecting the lawfulness of earlier processing.
3. Contact forms and email
Contact-form submissions are stored in a private Sanity dataset and delivered through Cloudflare Email Service to our Google Workspace email account. Our public contact address is support@davidmiskin.com.
Submissions are not publicly available. Access is restricted to authorised administrators, service providers and systems that need it to operate the website or handle enquiries.
The form uses a hidden field to reject automated spam and a rate limit of five messages per minute per IP address. The temporary rate-limit counter expires after one minute and is not stored with the submitted message. The site does not use Cloudflare Turnstile.
4. Audience measurement
The website uses Cloudflare Web Analytics to understand overall visits and website performance. This measurement does not use cookies or local storage and does not provide us with individual visitor profiles.
Cloudflare receives information such as the page URL, referring page, browser information and page-loading performance. We receive aggregate statistics rather than a record identifying individual visitors.
5. Videos and external content
Some pages contain YouTube videos in privacy-enhanced mode using youtube-nocookie.com. Before you select play, the page displays a still image served by the website and does not load the YouTube player.
Once the player loads, Google may receive your IP address, browser and device details and information about your interaction with the video, and may store information on your device. Privacy-enhanced mode does not mean that no information is processed after playback begins. Google’s privacy policy applies to its processing.
Links to publications, brands, social platforms and other independent websites lead to services with their own terms and privacy practices.
6. Cookies and similar technologies
We do not use advertising trackers or cross-site tracking tools of our own. Cloudflare Web Analytics does not use cookies or local storage. A technical cookie may be used by authorised editors when previewing website changes; it is not part of ordinary visitor browsing.
YouTube may use cookies or other device storage after you choose to play a video. You can choose not to play videos and can manage cookies through your browser settings. Restricting cookies or storage may affect third-party features.
7. Service providers and disclosures
We use Cloudflare for hosting, website delivery, protection, audience measurement and form-email delivery; Sanity for website content, image delivery and private contact-submission storage; and Google Workspace for business email. Sanity’s image-delivery service receives technical information, including IP addresses, when delivering images. Google also processes information when you choose to use a YouTube player.
We may disclose information to professional advisers where reasonably necessary, when required by law, or to protect legal rights or investigate misuse. Disclosures associated with a business transfer remain subject to applicable legal requirements.
8. International processing
Our providers may process information outside your country of residence. Cloudflare processes information in the United States and Europe. Sanity uses Google Cloud infrastructure in Belgium and the United States. Google may process information in the United States and other countries where it or its providers operate.
Applicable safeguards depend on the provider, service and transfer. Providers’ data-processing terms describe mechanisms including standard contractual clauses and, where applicable, UK transfer provisions or participation in a recognised Data Privacy Framework. These mechanisms are not identical for every provider or transfer. Contact support@davidmiskin.com for information about safeguards applicable to our services.
9. Retention
There is currently no fixed automatic deletion period for contact enquiries. We keep correspondence as a record of our exchanges and for ongoing enquiries, business records, dispute resolution and legal requirements, subject to applicable law and valid deletion requests.
Website request logs are retained for seven days. The temporary spam-prevention counter expires after one minute and is not attached to your enquiry.
If our retention practices change, we will update this policy to reflect the practice actually in operation.
10. Security
We use reasonable safeguards designed to protect personal information, including restricted access to private contact-form submissions. No website, transmission method or storage system is completely secure.
11. Your choices and rights
Your rights depend on your location and applicable law. They may include access, correction, deletion, portability, objection to or restriction of processing, and withdrawal of consent where processing relies on it. You may also have the right to complain to a relevant data protection authority.
Contact support@davidmiskin.com to make a request. We may need information to verify your identity and understand the request. We will respond within the period required by applicable law. Legal exceptions may require us to retain certain information.
12. Children
This website is intended for a general professional audience and is not directed to children under 13. If you believe a child has provided personal information to us, please contact us so we can investigate and take appropriate action.
13. Policy changes
We may update this policy to reflect changes in our practices or legal requirements. We will publish the updated version with its revision date and provide additional notice where required.
